Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Quantrader.ai platform, website, applications, and services (collectively, the “Service”) operated by EMG Solutions LLC (“Company,” “we,” “us,” or “our”), a limited liability company registered in the United States.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Definitions

“Platform” refers to the Quantrader.ai website, subscriber portal, APIs, and all related applications. “Content” refers to all text, data, analysis, market intelligence, trade setups, educational materials, indicators, and AI-generated content available through the Platform. “Subscriber” refers to any individual who creates an account on the Platform. “Subscription” refers to any paid plan (Basic, Pro, or Elite) purchased through the Platform.

2. Nature of the Service — Not Financial Advice

2.1. Quantrader.ai is a market intelligence, data analysis, and educational platform. THE SERVICE IS NOT AND SHALL NOT BE CONSTRUED AS: financial advice, investment advice, trading recommendations, a signal service, a broker-dealer, an investment advisor, or a fiduciary of any kind.

2.2. All market analysis, trade setups, AI-generated content, options flow data, GEX analysis, and any other market data or commentary provided through the Platform is strictly for EDUCATIONAL AND INFORMATIONAL PURPOSES ONLY.

2.3. The AI Trading Agent operates exclusively in paper trading mode. It does not execute real trades, does not use real money, and its performance is not indicative of actual trading results.

2.4. YOU ACKNOWLEDGE AND AGREE THAT: (a) trading stocks and options involves substantial risk of loss and is not suitable for all investors; (b) past performance of any tool, strategy, indicator, or AI system does not guarantee future results; (c) you are solely responsible for your own investment decisions; (d) you should consult with a qualified financial advisor before making any investment decisions.

3. Account Registration and Security

3.1. You must provide accurate, current, and complete information during registration.

3.2. You are responsible for maintaining the confidentiality of your account credentials.

3.3. The Platform enforces single-session access. Only one active session per account is permitted at any time. Logging in from a new device will terminate any existing session.

3.4. Account sharing, credential sharing, or providing access to multiple individuals under a single account is strictly prohibited and grounds for immediate termination without refund.

3.5. You must be at least 18 years old to use the Service.

4. Subscription and Billing

4.1. The Platform offers Free, Basic ($49/month), Pro ($99/month), and Elite ($179/month) subscription tiers, as well as annual billing options.

4.2. Paid subscriptions are billed in advance on a monthly or annual basis through Stripe.

4.3. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No prorated refunds are provided for partial billing periods.

4.4. We reserve the right to change subscription pricing with 30 days written notice to existing subscribers.

4.5. Free trials, when offered, provide temporary access to paid features. No credit card is required for free trials unless otherwise stated.

4.6. Promotion codes and coupons are subject to their specific terms, including expiration dates and usage limits.

5. Intellectual Property

5.1. All Content on the Platform is the exclusive property of EMG Solutions LLC.

5.2. TradingView indicators provided through the Platform are licensed exclusively to active subscribers. Access is revoked upon subscription cancellation.

5.3. You may not: (a) reproduce, distribute, or publicly display any Content; (b) reverse engineer any software or indicators; (c) share or redistribute indicator access tokens; (d) use Content for commercial purposes without written permission; (e) scrape or automatically extract data from the Platform.

6. AI-Generated Content Disclaimer

6.1. The Platform uses artificial intelligence (Anthropic Claude) to generate market analysis, trade setups, educational content, and other materials.

6.2. AI-generated content may contain errors, inaccuracies, or outdated information. We employ a 3-agent quality assurance system but do not guarantee the accuracy, completeness, or timeliness of any AI-generated content.

6.3. AI-generated content should never be the sole basis for any trading or investment decision.

7. Market Data

7.1. Market data is sourced from third-party providers including Alpaca Markets, Financial Modeling Prep, Market Data App, and others.

7.2. We do not guarantee the accuracy, completeness, or timeliness of market data.

7.3. Market data is provided for informational and educational purposes only.

8. Prohibited Uses

You agree NOT to: use the Platform for unlawful purposes; share account credentials; circumvent tier restrictions or rate limits; scrape or extract data; redistribute Content; develop competing products; interfere with infrastructure; or post harmful content in community channels.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EMG SOLUTIONS LLC SHALL NOT BE LIABLE FOR: (a) any trading losses or investment decisions made based on Content from the Platform; (b) any indirect, incidental, special, consequential, or punitive damages; (c) loss of profits, data, or business opportunities; (d) any damages exceeding the total amount paid by you in the twelve (12) months preceding the claim.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND.

10. Indemnification

You agree to indemnify and hold harmless EMG Solutions LLC from any claims, damages, losses, liabilities, and expenses arising from your use of the Service, violation of these Terms, or your trading decisions.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms. Upon termination, your access to paid features ceases immediately and TradingView indicator access is revoked.

12. Governing Law

These Terms are governed by the laws of the State of Florida, United States. Any disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS ARBITRATION.

13. Modifications

We may update these Terms at any time. Material changes will be communicated via email or Platform notification at least 15 days before taking effect.
